H8071 requires a background check for every ammunition purchase in Rhode Island, covering ammunition, shotgun shells, gunpowder, primers, bullets, and reloading components – treating every trip to buy ammo like a firearm transfer.
The Key Change
The bill creates § 11-47-65, a new section of Rhode Island law that does not currently exist. Before completing any ammunition sale, a seller must submit the buyer to a NICS check or contact state or local police and receive a cleared result. The mandate covers all ammunition and every component used by reloaders: primers, powder, and bullets. Wholesale sales from distributors to licensed retailers are exempt, as are sales to active law enforcement officers. Every other buyer must pass a background check first.
What It Means for Gun Owners
Every ammunition purchase at a gun shop, sporting goods store, or gun show requires a background check. Reloaders face the same requirement when buying components. There is no exemption for private transfers or online purchases.
Penalties:
- Sellers who complete a sale without a background check: fine up to $500 per violation
- Prohibited persons found in possession of ammunition: up to 1 year imprisonment and/or $1,000 fine
